Synopsis

El constitucionalismo (o neoconstitucionalismo) es la doctrina que describe y prescribe la transformación experimentada por los ordenamientos jurídicos en su tránsito desde el Estado liberal clásico al Estado constitucional actual. En la ciencia del Derecho se halla muy extendida hoy día la intuición de que el clásico problema de las relaciones entre Derecho y moral sobre el que positivistas y jusnaturalistas han discutido secularmente no puede ser indiferente a la profunda transformación que han experimentado los sistemas jurídicos y cuya seña de identidad más profunda consiste precisamente en que ciertos ideales morales han entrado a formar parte esencial de su sistema de fuentes bajo la forma de derechos constitucionales. En efecto tanto la centralidad de los derechos fundamentales en el sistema de fuentes como la profunda dimensión ética que presentan han contribuido a difundir la intuición de que la constitucionalización del Derecho dificulta una concepción positivista del Derecho. El autor pretende articular una justificación de esta intuición a partir del análisis de dos aspectos relevantes de los derechos fundamentales. Bajo el aspecto de los contenidos parece evidente que ciertos ideales morales han sido incorporados al sistema jurídico dificultando una división clara entre Derecho y moral. Bajo el aspecto puramente formal (esto es estructural y funcional) los derechos fundamentales impulsan un razonamiento jurídico que va más allá de los planteamientos legalistas y formalistas porque la única manera de hacer inteligibles conceptos constitucionales como igualdad libertad o dignidad consiste en inscribirlos en una argumentación moral que rebasa las fronteras del Derecho estrictamente positivo. A juicio del autor no es posible argumentar jurídicamente sin argumentar moralmente en el Estado constitucional.
